If the Respondent does not file a Respondent’s Notice, the Appellant can ask the Court of Appeal to allow the appeal without a hearing. If the Respondent does file a Respondent’s Notice, the matter will be set down for a hearing. The hearing will be before a panel of three judges. The judges will consider the Appellant’s and Respondent’s grounds of appeal and resistance and will also hear oral submissions from both parties. They will then make a decision on whether to allow or dismiss the appeal.
